OHLA and Italian partners Rizzani de Eccher and Trevi lose claim for €280 million damages from Kuwait

Link Securities | The International Centre for Settlement of Investment Disputes (ICSID), the World Bank’s arbitration body, has dismissed the request for annulment filed by Spanish construction company OHLA and its partners, Italian companies Rizzani de Eccher and Trevi, against the original award handed down in 2022 in the dispute against Kuwait, Expansión newspaper reports today. OHLA and its partners claimed ICSID jurisdiction to arbitrate this lawsuit, in which they estimated damages of around €280 million. Following this ruling, OHLA will now only be able to renegotiate the terms of the contract settlement directly with the client or go to court in Kuwait, which complicates the recovery of the money.
