Supreme Court agrees to hear Ferrovial’s appeal regarding insufficient compensation awarded for unfinished M-203 motorway

Link Securities | The company will continue its battle with the Madrid Regional Government over the M-203, a motorway between Vallecas and Alcalá de Henares that Ferrovial was awarded in 2005 but was never able to complete.

The Supreme Court (TS) has accepted for consideration the appeal lodged by the infrastructure group against the ruling issued by the High Court of Justice of Madrid (TSJM) in February 2025. In that ruling, the judge rejected Ferrovial’s claim for higher compensation following the termination of the contract for the construction and operation of the road. The main point of contention centres on the applicable interest.

In 2021, the Community of Madrid paid the M-203 concessionaire, owned by Ferrovial, €73.38 million in respect of the investment’s asset value (VPI) as a result of the termination of the works concession contract. This figure is a far cry from the nearly €250 million claimed by the company (€144 million for loss of profits).
